President Obama has threatened to write executive orders that will infringe on section 8 of article I of the Constitution of the United States and on the Second Amendment. Senator Rand Paul of Kentucky introduced Senate Bill S. 2434 to try and stop Obama cold in his tracks.
The short title of S. 2434 is the “Separation of Powers Restoration and Second Amendment Protection Act”. Senator Rand Paul introduced it to the Senate on December 18, 2015. It is now on the Senate Legislative Calendar.
Senate Bill 2434 starts out by stating: “A bill to provide that any executive action that infringes on the powers and duties of Congress under section 8 of article I of the Constitution of the United States or on the Second Amendment to the Constitution of the United States has no force or effect, and to prohibit the use of funds for certain purposes.”
Any Presidential executive action that infringes on the Second Amendment or the powers of Congress is reduced to an “advisory only” recommendation. All prior Presidential executive actions that infringe on Congress or the Second Amendment are also reduced to a suggestion and cannot be enforced as law.
Unlike other legislation that Congress has written, Senate Bill 2434 explicitly defines executive action as “an Executive order, memoranda, proclamation, or signing statement.”
